Deed and ACC Violations - What is the best way to deal with violations I see? 

You can certainly report violations to the Association by submitting a request on the TownSq page.

Dead Trees - What can I do if there are dead trees on an adjacent property that threaten to cause damage to my property or are unsightly?

You should first ask your neighbor to remove the trees. If that is unsuccessful, a registered letter to the owner with a copy to your own insurance carrier might get results. If you think that the high voltage power lines along the street are threatened you should contact Entergy (1-800-368-3749). This is essentially a problem between property owners and the association has no authority to intervene. However, the association will send a letter to the owner expressing your concerns if you so desire but you should also take the steps outlined above.

Drainage - Who is responsible for keeping gullies, swales and ditches clear?  

Roadside right-of-way ditches are maintained by the county and if you see a problem you can contact the county at 281-259-6492. All drainage on private property is the responsibility of the property owners, this includes the drainage that is typically on the side or rear of lots in our neighborhood. According to state law it is the responsibility of property owners to keep them clear and unobstructed. The Property Owners Association does NOT own the land where the drainage is located and is not responsible for maintaining them. The only land in the subdivision owned by the association are reserves A, B and C where the clubhouse, the tennis courts and the greenbelt along the Northeast end of Creek Forest Lane are located. Section 11.086 of Texas water law covers alterations and impoundment of surface water flow.

What do I do when I see golf carts, 4 wheelers and ATVs being operated on our streets? 

 If you see anyone driving a ride-astride, handle-bar controlled 4-wheeler call the sheriff non-emergency number (936-760-5871) immediately because these vehicles are illegal to operate on the street. Golf carts are generally OK as long as they are operated on the pavement and the driver holds a valid driver's license. If you observe an obviously under-age driver or off-pavement operation call the sheriff. The roads in Lake Creek Forest subdivision are public county roads, not private community roads, and are under the jurisdiction of Montgomery County, not the POA. They are open to any member of the public for legitimate use including hiking and bicycling. All vehicles and their drivers are subject to the rules and regulations of any public road.  

What if my neighbor's septic system is malodorous?  

Contact your neighbor and explain the problem and see if you can mutually solve the issue. If you are unable to resolve it contact the county: Montgomery County Environmental Health Dept.

Association Fees - What are my fees used for?

The Property Owner's Association is charged with maintaining common property and enforcing the covenants of the subdivision. The majority of costs go to:

  • Mowing the public road rights-of-way ditches
  • Street lighting
  • Maintaining the park playground and tennis court 
  • Maintaining the clubhouse and basketball court
  • Water use for the parks and clubhouse
  • Mosquito spraying
  • Communication through signage, etc.
  • Administrative cost through Goodwin & Co; our property management partner

Why are there no fire hydrants in Lake Creek Forest? 

 The Board of Directors has been informed by Aqua Texas and Needham Fire Rescue that the water system is not capable of free flowing the amount of water in gallons per minute necessary to supply the pumper trucks. Needham Fire Rescue has stated that they are well prepared to quickly fight fires using tanker trucks to fill the large portable reservoirs which supply the pumpers. When can I put my trash out?

You should not place your trash out earlier than 5PM the day before pickup. Trash visible in front of the home may be considered a nuisance to the community and could violate the POA covenants. Homeowners must follow the rules set out by their refuse collector to ensure proper pick up. If additional bags are placed by a container or the lid of the trash can cannot be closed your house might be skipped; the operators will not pick it up if they think the trash might spill when they are using the automatic lifts. If you have more refuse than you can properly fit in your container contact your refuse provider for special arrangements.  

Removing Deadfall - Undergrowth - Diseased Trees --Do I need to seek association approval to clean up my lot by removing deadfall, dead or diseased trees and underbrush? 

No. As long as you don't remove healthy trees which measure six inches or more in diameter one foot above the ground. Such activity is encouraged because it improves the appearance of the subdivision. It is perfectly acceptable to send usable dead trees or trees removed in accordance with an approved clearing application to a lumber mill. State Law, which is enforced by the county, requires that weeds be controlled and clearing can sometimes encourage weed growth therefore it is required that weeds be controlled in accordance with state law.

Recycling - Is recycling available in our neighborhood?
